Acceptable Use Policy
Effective date: 30 September 2026
This policy sets out what you may not do with Harvanera's Service. It forms part of our Terms of Service and applies to everyone who uses the Service, including anyone using a product you build on top of it.
1. Model providers' policies apply too
Every request you send is processed by a third-party model provider. In addition to this policy, you must follow the applicable terms and usage policies of the provider whose model you use:
- OpenAI: Usage Policies
- Anthropic: Usage Policy
- Google: Generative AI Prohibited Use Policy
- DeepSeek: Open Platform Terms of Service
- Alibaba Cloud (Qwen): Model Studio agreements
If a provider's applicable policy is stricter than this one on a given point, the stricter rule applies to requests sent to that provider's models.
2. Prohibited uses
You must not use the Service to create, request or distribute content, or to carry out activities, that:
2.1 Harm people
- sexualise or exploit children in any way, including child sexual abuse material (we report such material to the relevant authorities);
- promote, incite or facilitate violence, terrorism or violent extremism;
- threaten, harass, bully, stalk or intimidate anyone;
- promote self-harm or suicide, or give instructions for it;
- help develop or use biological, chemical, nuclear or radiological weapons, explosives or other weapons capable of mass harm;
- facilitate human trafficking or exploitation.
2.2 Break the law or others' rights
- are illegal where you are or where the content is used;
- infringe intellectual property, privacy or other rights of others;
- collect, process or disclose personal data unlawfully, including building profiles of individuals without a legal basis, or processing sensitive data without the required safeguards;
- facilitate fraud, scams, phishing, money laundering or financial crime;
- violate sanctions or export control laws, including use from a restricted location or by a sanctioned person, as described in our Terms of Service.
2.3 Deceive or manipulate
- impersonate a person or organisation, or create deepfakes of real people without their consent;
- run disinformation or influence campaigns, including fake reviews, fake accounts or coordinated inauthentic behaviour;
- deploy a chatbot or other AI system to interact with people without telling them they are interacting with AI where this is not obvious or disclosure is required by applicable law, including Article 50 of the EU AI Act where it applies;
- present AI-generated content as human-written where this misleads people in a way that causes harm, or fail to label AI-generated content where the law requires it;
- use manipulative or exploitative techniques that distort people's behaviour and are likely to cause harm, or any other practice prohibited by Article 5 of the EU AI Act where it applies.
2.4 Make high-risk decisions without safeguards
- make automated decisions that significantly affect people (for example, about credit, employment, housing, insurance, education, access to essential services or legal status) without appropriate human oversight and compliance with the laws that apply to such decisions;
- provide medical, legal or financial advice to others without a qualified professional reviewing it, where the law or the model provider's policy requires this.
2.5 Attack systems or abuse the Service
- create malware, ransomware or tools for unauthorised access, or attack any system or network;
- test the security of the Service without our written permission (please report vulnerabilities to info@harvanera.com);
- overload the Service, bypass rate limits, spending limits, content filters or safety measures of the Service or of any model;
- attempt to "jailbreak" models to produce content prohibited by this policy;
- share API keys publicly, sell or rent accounts or keys, or create multiple accounts to obtain welcome credit;
- send spam or bulk unsolicited messages;
- use outputs to develop models that compete with a model provider where that provider's terms prohibit it.
3. Your responsibilities as a developer
If you let other people use a product built on Harvanera:
- you are responsible for their use, and you must make them follow rules at least as strict as these;
- you must have a way for them to report abuse and act on reports;
- you must give them the information and notices the law requires, including a privacy notice and AI disclosure where applicable.
4. What we do about breaches
We do not read your requests by default and do not pre-screen content. We may act when we receive a report, detect abnormal use in request metadata, or are notified by a model provider, payment processor or authority.
Depending on how serious the breach is, we may:
- warn you and ask you to fix the problem;
- block specific requests, models or API keys;
- suspend or close your account, as described in the Terms of Service;
- report illegal content or activity to the relevant authorities.
Where we can, we will tell you what we did and why. You can challenge a decision by emailing info@harvanera.com with your account email, the decision you are challenging and any relevant information. We review reports and challenges according to their urgency and the information available, and respond within a reasonable time. We may not be able to share details where doing so would compromise security, an investigation or a legal obligation.
5. Reporting abuse
To report abuse of the Service or illegal content generated through it, email info@harvanera.com with as much detail as you can (for example, where you saw it and why you believe it breaks this policy).
